WiseDine, Inc. (“Company,” “we,” “our,” or “us”) provides this privacy notice (“Privacy Notice”) to describe our practices regarding the collection, use, sharing, and protection of your Personal Information on the website located at www.wisedine.app (the “Website”), and the WiseDine mobile application (the “App”). The services and content we provide through the Website and App are collectively referred to herein as the “Services”. This Privacy Notice also tells you about the choices you have with respect to your Personal Information, how you can assert those choices, and how you can contact us to get answers to your questions.
Please note that our privacy practices are subject to the applicable laws of the regions in which we operate. Accordingly, some additional region-specific terms will only apply to individuals in those locations, or as required by applicable laws.
BY USING OR ACCESSING THE SERVICES, YOU AGREE TO THIS PRIVACY NOTICE. IF YOU DO NOT AGREE WITH THE POLICIES OR PRACTICES DESCRIBED IN THIS PRIVACY NOTICE, YOU SHOULD NOT USE OR ACCESS THE SERVICES OR PROVIDE US WITH ANY PERSONAL INFORMATION.
WHAT OUR PRIVACY NOTICE COVERS
This Privacy Notice applies to the Personal Information that we obtain in various contexts, including when you:
- Access or use our Website or App
- Communicate with us over email or otherwise via the Services
- Engage with us on social media
- Provide Personal Information as otherwise described in this Privacy Notice
We may provide different or additional privacy notices in connection with certain activities, programs, and offerings. Additionally, we may provide additional “just-in-time” notices or notices at collection that may supplement or clarify our privacy practices or provide you with additional choices regarding your Personal Information.
PERSONAL INFORMATION WE COLLECT FROM YOU
We use the term “Personal Information” – also called “personal data” or “personally identifiable information” in the laws of some jurisdictions – to refer to information that reasonably identifies, relates to, describes, or can be associated with you. Data that has been deidentified or that otherwise cannot reasonably be related back to a specific person is not considered Personal Information. The precise definition of Personal Information may vary depending on your place of residence.
The following are the categories and types of Personal Information that we may collect from or about you, depending on how you interact with the Services:
- When visiting the Website, we collect identifiers, such as your name, institutional email address, and other contact information; we may also collection information contained in any inquiries you submit through our support channels;
- When using the App, we collect information required to create and maintain your WiseDine account, which may include your name, institutional email address, username and password, profile preferences, dietary details, and information you choose to share regarding your health goals or meal preferences;
- The Website and App may collect device and online identifiers and related information, including internet protocol (IP) address, mobile identifier, data collected from cookies and other online tracking technologies, and similar unique identifiers;
- Internet or other electronic network activity information on our Services;
- Non-precise geolocation information; and
- Any other Personal Information that you voluntarily provide us.
NON-PERSONAL INFORMATION
We may collect information that is not Personal Information (“Non-Personal Information”), which may include anonymous or aggregate data, or information. Because Non-Personal Information does not personally identify you, we may collect, use and disclose Non-Personal Information for any purpose permitted by applicable law. In some instances, we may combine Non-Personal Information with Personal Information, in which case the combined information will be treated by us as Personal Information to the extent that it may be used to personally identify you. We reserve the right to develop and derive aggregate data (meaning information that relates to a group or category of individuals, from which individual identities have been removed) from Personal Information to enhance and maintain the Services, and such aggregate data will be treated as non-Personal Information.
HOW WE COLLECT YOUR PERSONAL INFORMATION
Personal Information You Provide
We collect Personal Information that you provide to us directly. This may include, but is not limited to:
- Information you provide when you contact us through email or other Internet-enabled communications;
- Information you provide when you sign up for newsletters or other communications;
- Information you provide when you create a user profile or an account with us;
- Details relating to meal selections or meal logging that you carry out through the App;
- Any other Personal Information that you provide us on or through the Services.
Personal Information We Collect Automatically
We may also automatically collect information, including Personal Information, from you when you visit or use our Services. While some of this information (like a device ID or cookie ID) does not enable us to directly identify you or other users (e.g., we do not know your name or contact information through such information), that information may still be considered Personal Information under applicable privacy laws. Such information may include data collected by the following methods:
Cookies and Similar Technologies
We or our services providers may store information on your device as a cookie or may use other data collection technologies (such as clear gifs, tracking pixels, web beacons, tags, and similar technologies (collectively, “Tags”)) to collect data related to usage of our Services. Such data may include, without limitation, the type of browser you are using, your Internet Protocol (IP) address or mobile device identifier, what pages or areas on the App you visited and what links you clicked on, and the general region where your device is located. We do not collect any precise geolocation data, as defined under applicable privacy laws.
Website Analytics
We may conduct website analytics to help us track and understand how visitors use our Website. Any such analytics tracking will be conducted using our own internal analytics technologies.
Social Media Platforms and Networks
If you interact with us on social media or use features, such as plugins, widgets, or other tools made available by social media platforms or networks (such as LinkedIn, Instagram, Facebook, TikTok, or X) in connection with our Services, we may collect information that you share with us on social media or that such platforms share with us. Please review the privacy notices and settings of the social media platforms and networks that you use for more information about their privacy practices.
Other Sources
We may obtain information about you from other sources, such as fraud prevention vendors, vendors that provide other services on our behalf, or publicly available sources.
DINING DATA PROVIDED BY PARTICIPATING INSTITUTIONS
We receive meal offerings and nutrition-related information from dining departments of educational institutions that participate in our Services. Such information may include menu data, meal categories, ingredient lists, allergen information, and other dining-related data. Such information is not considered Personal Information under applicable laws and is processed within our Website and App solely to provide the Services. We collect such meal-related information pursuant to separate agreements with participating institutions, and do not disclose your personal information, including your meal-related preferences, to participating institutions.
HOW WE USE YOUR PERSONAL INFORMATION
We use Personal Information and other information as described herein including for the following purposes:
- To contact you about our Services and to provide our Services to you;
- To create, maintain, customize, and secure your account with us, and to personalize your experience when using the Services;
- To send you updates or other information;
- To send you requested meal information;
- To operate the Services and to provide you with any specific services that you have requested;
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us;
- To help maintain the safety, security, and integrity of our Services, databases and other technology assets, and business;
- For internal research; for technological development and demonstration; and to improve, upgrade, or enhance the functionality our Services;
- For detecting security incidents; protecting against malicious, deceptive, fraudulent, or illegal activity; and prosecuting those responsible for that activity;
- To investigate suspected fraud, harassment, or other violations of any law, rule, or regulation, or the policies for the Services;
- As required by law or legal process;
- To respond to your direct inquiries;
- To add you to our mailing lists and send you emails from time to time; and
- For any additional purposes to which you specifically consent.
HOW WE DISCLOSE OR SHARE YOUR PERSONAL INFORMATION
Besides using your Personal Information ourselves, we may disclose your Personal Information and other information in the following instances:
- Authorized Athletics Coaches. With your written authorization, which shall be collected via the App before any Personal Information is made available to any third party, we may allow coaches of athletic teams on which you participate at your educational institution to access relevant portions of your account related to meal logging. Additionally, authorized coaches may permit dieticians employed by or otherwise providing services to your educational institution’s athletic program to access to relevant portions of your account related to your meal-logging data. If granted access, neither authorized coaches nor institution-affiliated dieticians may use or share your Personal Information for their own personal or commercial purposes.
- Service Providers and other Third-Party Processors. We may disclose your Personal Information to third parties who may use your information to provide us services such as website hosting, data analysis, infrastructure provision, information technology services, customer service, e-mail delivery services, auditing, and anti-fraud monitoring. These third parties may have access to Personal Information that is necessary to perform their functions, but they are only permitted to use such information in connection with performing services for us pursuant to written contracts. They are not authorized by us to use or disclose such information for their own benefit or the benefit of other third parties.
- Legal Compliance and to Defend Our Rights. We may disclose Personal Information and other information as we believe necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process, including to respond to requests from public and government authorities from jurisdictions outside your country of residence; (c) to enforce our terms and conditions; (d) to protect our operations or those of any of our affiliates; (e) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (f) to allow us to pursue available remedies or limit the damages that we may sustain.
- Business Transfers. We may disclose your Personal Information and other information to third parties in connection with a corporate restructuring, acquisition, or divestiture.
- Aggregated or Non-Personal Information. We may disclose aggregated information or Non-Personal Information to unaffiliated third parties, such as business partners, manufacturers, distributors, and retailers, in a form in which the disclosed information will not contain nor be linked to any Personal Information, including without limitation to improve and enhance your experience using the Services, and for our market research activities.
Please note that if you specifically consent to additional uses of your Personal Information, we may use your Personal Information in a manner consistent with that consent.
NO TARGETED OR INTEREST-BASED ADVERTISING TO STUDENTS
We do not process students’ Personal Information to conduct targeted or interest-based advertising or marketing campaigns with participating institutions or in any other context.
HOW WE PROTECT YOUR PERSONAL INFORMATION
We implement reasonable and appropriate physical, technical, and organizational safeguards designed to promote the security of our systems and protect the confidentiality, integrity, availability, and resilience of Personal Information. Such safeguards include encryption in transit, encryption at rest, access controls, logging and monitoring, and periodic security reviews. Personal information is maintained on our servers or those of our vendors, and is accessible only by authorized employees, third parties to whom you have granted consent, independent contractors, and agents as necessary for the purposes described in this Privacy Notice. Nevertheless, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and Company, or information stored on the Website, in the App, through our Services, or on our servers, will be free from unauthorized access by third parties such as hackers, and your use of the Services demonstrates your assumption of this risk. If you have reason to believe that your interaction with us is no longer secure (for example, if you believe that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us at privacy@wisedine.app.
DATA STORAGE
In connection with the Services we provide at specific institutions, we store and process Personal Information in data centers located within the United States. We do not transfer or process Personal Data outside the United States without first obtaining express written permission from the applicable institution.
DATA RETENTION
We will retain your information for as long as your account is active or as needed to provide you with the Website or Services, and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your information, we may continue to retain and use anonymous or aggregated data previously collected.
BREACH NOTIFICATION
In the event that we learn of or suspect a data security incident that materially affects Personal Information we store or process, then we shall notify the participating institution, affected users, and, if required, any regulatory authorities, within a timeframe consistent with applicable law and contractual obligations.
LINKS TO OTHER SITES AND SOCIAL MEDIA PLATFORMS
Our Services may contain links to other websites, applications or services that are not owned or controlled by us, including links to social media platforms, or may redirect you outside our Services to other websites or locations for information or other services. This Privacy Notice only applies to information collected by us through our Website. We are not responsible for the privacy and security practices of other websites, applications, services, or social media platforms, or the information they may collect (which may include IP addresses or device identifiers). You should refer to such third parties’ privacy policies on their sites to determine their respective privacy practices. Links to any other websites, applications, services, social media platforms, or content do not constitute or imply an endorsement or recommendation by us of the linked website, application, services, social media platform, and/or content.
You should be aware that any Personal Information that you voluntarily include and transmit online in a publicly accessible blog, forum, social network, or otherwise may be viewed and used by others. By using such features, you assume the risk that the Personal Information provided by you may be viewed and used by third parties.
CROSS-BORDER DATA TRANSFERS
If you submit Personal Information to us, such information shall be processed in the United States, where privacy laws may be less stringent than those in your country of residence. By submitting your Personal Information to us, you agree to the transfer, storage, and processing of such information in the United States. Your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States.
CHILDREN’S PRIVACY
Our Services are intended for users ages 18 and over. We do not knowingly collect Personal Information from persons ages 17 and under, except as provided below in this section. If you are under 18, we request that you do not send any Personal Information to us, such as name, email address, or other Personal Information set forth in this Privacy Notice, or access or submit any such information through the Services. In the event we become aware that Personal Information (or other information protected under applicable law) from a person under 18 (or such other age as may be restricted under applicable law) has been collected, except in accordance with the alternative provision stated below in this section, we will use all reasonable efforts to delete such information from our database. If you believe we may have any Personal Information from or about a person 17 years of age or under, please contact us at privacy@wisedine.app.
If you are between 17 and 18 years old, you may provide written consent to our collecting and processing your Personal Information in accordance with this Privacy Notice by following the consent procedure provided through the App, or by emailing us at privacy@wisedine.app.
YOUR CHOICES
Delete Account
You may delete your WiseDine account and profile at any time by contacting us at privacy@wisedine.app or by following the deletion procedures available through the App.
Withdraw Consent
If you have consented to allowing coaches and/or dieticians to access your account dashboard, as set forth in the How We Disclose Or Share Your Personal Information section above, you may withdraw such consent at any time by contacting us at privacy@wisedine.app.
Email Messages
If you receive a marketing/promotional email from us, you may unsubscribe from any future such emails by sending an unsubscribe request to privacy@wisedine.app or by clicking the “unsubscribe” link in a marketing/promotional email that you receive from us. We will process your request within a reasonable time after receipt. The same unsubscribe feature is available if you have signed up for our newsletter, updates through the Website or App, or other communications from us, and no longer wish to receive such communications.
Cookies and Tracking Technologies
As described above in Personal Information We Collect Automatically, we may use cookies and other tracking technologies for the purposes stated in that section.
If you would like to stop or restrict the placement of cookies or flush any cookies that may already be on your computer or device, please refer to and adjust your web browser preferences. Further information on cookies is available at www.allaboutcookies.org. Note that cookie-based opt-outs must be performed on each device and browser that you wish to have opted out. For example, if you have opted out on your device browser, that opt-out will not be effective on your mobile device. Additionally, if you opt out on one of your devices, that opt out may not be effective on all of your devices. However, please be advised that cookie-based opt-outs are not effective on some mobile services.
CHANGES TO THIS PRIVACY NOTICE
We reserve the right, at our discretion, to update this Privacy Notice at any time and will notify you of any material changes to the way in which we treat Personal Information by posting an updated Privacy Notice or other notice on relevant areas of our Services. Any updated version of this Privacy Notice will be effective immediately upon posting unless otherwise specified. Your continued use of the Services after the effective date of the revised Privacy Notice will constitute your consent to those changes. However, we will not, without your consent, use your previously collected Personal Information in a manner materially different from what was stated at the time your Personal Information was collected. We encourage you to periodically review the Website and App for the latest information on our privacy practices.
